Halal conditions

The business owners follow halal rules very strictly in their personal and business lives.

  • Customers are strictly not deceived.
  • Customers are fully and thoroughly informed; nothing is hidden from them
  • Swearing oaths is strictly not permitted in dealings with either party.
  • Praising a property excessively or exaggerating its qualities is forbidden.

More details:

  • Not concealing defects (prohibition of tadlis): Any hidden problem with a property (water leaks, document defects, weak foundations, noise in the neighbourhood, etc.) must be disclosed to the client. Hiding these details in order to sell the home makes the resulting profit haram.
  • Legal education of the client: It is a core duty not merely to sell the property but to fully inform the consumer about its real legal status (whether an extract exists, its designated use, persons registered).
  • Avoiding artificial prices and exaggeration of qualities (prohibition of najash): It is essential not to praise a property excessively. Likewise, manipulations that do not reflect reality, such as creating a false sense of urgency in the client with "there are other customers too, the price will go up tomorrow", are forbidden.
  • Clarity of the brokerage fee (absence of gharar): The service fee of "İsra Əmlak" (a percentage or a fixed amount) must be stated clearly and transparently to both parties at the start of the transaction. At the end of the job, no hidden costs or extra demands under the name of a "sweetener" may be put forward.
  • No dealing "behind closed doors": The intermediary (broker) may not add a large sum on top of the price set by the seller, without the seller's knowledge, and sell to the buyer at that price (an agreement such as "sell for whatever you can, but you will give me this much" is allowed). The intermediary's earnings must be a commission agreed in advance.
  • Not guiding interest-based (riba) transactions: It is not permitted to broker home sales and purchases through haram means such as mortgages or interest-bearing loans. The sale and purchase must be completed between the parties in plain cash.
  • Protecting the rights of both parties: The intermediary must protect not only the party who pays the commission (for example, the seller) but also the rights of the buyer. Because in Islamic fiqh the intermediary holds the status of an "Amin" (trustworthy) person, trusted by both parties. The intermediary must serve the formation of an objective market price.
  • Refusing wrongfully acquired properties: It is strictly forbidden to broker the sale or rental of properties whose documents are seriously suspected of forgery, or where heirs' rights have been trampled or which have been seized (taken by injustice).

The Azerbaijani market has very strong potential for real estate services. The real estate sector is one of the main sectors where the principles of honesty and transparency are most often violated, people are deceived and harmed, and disputes arise. We believe İsra Əmlak will blaze an exemplary trail in this sector.
